Hello and Welcome! This document establishes a legally binding agreement between the developer (hereinafter referred to as "Developer," "Speqpro," "we," "us," or "our") and you, the user (hereinafter referred to as "you" or "User"), governing your access to the Speqpro mobile application (the "App").
Please read these Terms carefully before you start using our App.
By accessing the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you don't agree with any part of these Terms, please don't use the App.
By accessing or using the Services, you represent and warrant that you are at least 13 years of age (or the minimum age required by the laws of your jurisdiction to use the App without parental consent). If you are between the age of 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Some features of the App might require you to create an account.
As long as you follow these Terms, Speqpro gives you a limited, non-exclusive, non-transferable, and non-sublicensable right (a license) to download, install, and use our App on your personal device(s) for your own personal, non-commercial enjoyment.
You agree not to do any of the following:
The App might offer optional purchases or subscriptions for extra features or content directly within the App.
The App itself, including all the technology, design, text, graphics, and other content (except your User Content, see below), and all related intellectual property rights, belong exclusively to Speqpro and our partners (licensors).
Using the App doesn't give you ownership of the App or its content; you only get the limited permission to use it as described in these Terms. We reserve all rights not expressly granted to you in these Terms.
Certain Services may display, include or make available content, data, information, applications or materials from third parties (“Third-Party Materials”) or provide links to certain third-party websites. Third-Party Materials include the open source software or other third-party software, such as third-party large language models, that are included in the artificial intelligence and machine learning models you access or use through the Services. By using the Services, you acknowledge and agree that Speqpro is not responsible for examining or evaluating the content, accuracy, completeness, availability, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third-Party Materials or websites. We do not warrant or endorse and do not assume and will not have any liability or responsibility to you or any other person for any third-party services, Third-Party Materials or third-party websites, or for any other materials, products, or services of third parties. You acknowledge and agree that for any content generated within the App at your request using third-party generative AI tools, including large language models (such as text, images, and audio, collectively "AI-Generated Content"), you grant Speqpro a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to store, process, reproduce, modify, adapt, display, distribute, and otherwise use such AI-Generated Content for the purposes of providing, maintaining, improving, and developing the Service.
We might send you push notifications, or other messages related to our services, updates, or promotions. You can usually manage notification preferences in the App or your device settings.
Speqpro may terminate your access and use of the Service immediately at any time, for any reason, and at such time you will have no further right to use the Service. You may terminate your Speqpro account at any time by following the instructions available through the Service.
WE PROVIDE THE APP "AS IS" AND "AS AVAILABLE". THIS MEANS WE DO NOT MAKE ANY PROMISES OR GUARANTEES (WARRANTIES) ABOUT HOW THE APP WILL WORK OR IF IT WILL ALWAYS BE AVAILABLE.
TO THE FULLEST EXTENT THE LAW ALLOWS, WE SPECIFICALLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You acknowledge that the Services may generate Output containing incorrect, biased, or incomplete information. Speqpro shall have no responsibility or liability to you for the infringement of the rights of any third party in your use of any Output. You should not rely on the Services or any Output for advice of any kind, including medical, legal, investment, financial or other professional advice. Any Output is not a substitute for advice from a qualified professional. You acknowledge that due to the nature of generative artificial intelligence tools, other users of the Services may create and use their own Output that is similar or the same as your Output, such as because the same or similar Input was provided, and you agree that such other users can use their own individually created Output for their own internal business purposes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEQPRO AND ITS DEVELOPERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THIS INCLUDES, FOR EXAMPLE, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE KNEW OR SHOULD HAVE KNOWN THAT SUCH DAMAGES WERE POSSIBLE. THIS APPLIES TO ANY CLAIM ARISING FROM OR RELATED TO YOUR USE OF, OR YOUR INABILITY TO USE, THE APP.
IN ANY CASE, THE TOTAL LIABILITY OF SPEQPRO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS TO YOU FOR ALL CLAIMS RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, TO USE THE APP IN THE 12 MONTHS BEFORE YOUR CLAIM AROSE.
You agree to indemnify, defend, and hold harmless Speqpro and its affiliates, developers, officers, directors, employees, agents, licensors, and suppliers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) that arise from:
These Terms shall be governed by and interpreted in accordance with the laws of India, without reference to its conflict of law rules. You agree that any dispute arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in India. By using the App, you consent to the personal jurisdiction of these courts for the resolution of any such disputes.
We might update these Terms from time to time. If we make changes, we will post the updated Terms here and change the "Last Update" date at the top. We encourage you to check this page periodically to stay informed.
By continuing to use the App after we post changes, you accept the new Terms.
